Photography & Videography Intellectual Property, Delivery & Usage Rights

Ownership of Content

​

All photographs, videos, audio recordings, edited content, digital files, and other media created by Vanguard Events & Entertainment ("Vanguard") remain the exclusive intellectual property of Vanguard.

​

Vanguard retains full copyright and all intellectual property rights in all media captured, created, edited, produced, or supplied in connection with the event, including but not limited to photographs, video footage, edited files, previews, highlight reels, promotional content, and associated materials.

​

No ownership rights are transferred to the Client unless expressly agreed in writing.

​

Client Licence

​

Upon full payment of all invoices, the Client is granted a non-exclusive, non-transferable, revocable licence to use delivered media for personal, internal business, and non-commercial purposes.

This licence permits the Client to:

• Download and store delivered files.

• Share media with family, friends, guests, and event attendees.

• Publish media on personal social media accounts.

• Display media within private residences or internal business environments.

• Use media for personal record keeping and event memories.

The licence does not permit commercial exploitation, resale, sublicensing, or transfer of rights.

​

Commercial Use

​

Commercial use of any photographs, videos, audio recordings, or media requires Vanguard's prior written consent.

Commercial use includes, but is not limited to:

• Advertising campaigns

• Paid marketing

• Product promotion

• Media publication

• Sponsorship activities

• Third-party licensing

• Sale of media

• Commercial distribution

Additional licensing fees may apply.

​

Editing, Alteration & AI Use

​

The Client must not alter, edit, manipulate, crop, recolour, apply filters, remove watermarks, create derivative works, use artificial intelligence tools, or otherwise modify any delivered media without Vanguard's prior written approval.

This restriction includes but is not limited to:

• AI enhancement tools

• AI image generators

• Video editing software

• Colour grading modifications

• Overlay graphics

• Removal of branding or credits

Reasonable resizing for social media platforms is permitted.

​

Raw Files & Source Material

​

Raw photographs, unedited footage, source files, project files, timelines, layered edits, audio stems, working files, and backup files remain the exclusive property of Vanguard.

​

Unless otherwise agreed in writing, raw or unedited materials will not be supplied.

Delivered media represents Vanguard's final creative product and professional standard.

​

Artistic Discretion

​

The Client acknowledges that photography and videography are artistic services.

​

Creative decisions regarding shooting style, editing style, colour grading, composition, image selection, music selection, storytelling, sequencing, and final deliverables remain solely at Vanguard's discretion.

​

Differences in artistic style, editing preferences, lighting conditions, weather conditions, venue conditions, guest participation, event timing, or subjective expectations do not constitute grounds for refund, compensation, re-editing, or breach of contract.

​

Event Conditions & Missed Content

​

The Client acknowledges that the quality and quantity of captured media may be affected by circumstances outside Vanguard's control, including but not limited to:

• Venue restrictions

• Poor lighting

• Weather conditions

• Guest behaviour

• Venue layout

• Delayed schedules

• Restricted access

• Safety concerns

• Obstructions

• Equipment restrictions imposed by venues

• Failure of guests to participate or cooperate

While Vanguard will use reasonable skill and care to capture key moments, Vanguard cannot guarantee that every person, detail, moment, speech, activity, or event element will be captured.

​

Technical Failure

​

Vanguard maintains professional equipment and reasonable backup procedures.

​

However, the Client acknowledges that equipment failure, memory card corruption, power failure, internet outages, software issues, file corruption, accidental loss, theft, damage, or other unforeseen technical issues may occasionally occur despite reasonable precautions.

​

In the unlikely event of total failure to deliver photography or videography services due solely to Vanguard's negligence, Vanguard's liability shall be limited to the amount paid for the affected service.

​

Credit & Attribution

​

Where media is shared publicly, Vanguard appreciates appropriate credit through tagging or mentioning Vanguard Events & Entertainment.

​

Commercial users approved by Vanguard may be required to provide attribution as part of any licensing agreement.

​

Delivery Timeframes

​

Photography and videography delivery timelines are estimates only.

​

Typical delivery timeframes are:

Photography

• Sneak preview (where offered): Within approximately 48 hours to 14 days.

• Full gallery delivery: Approximately 4 to 10 weeks.

Videography

• Highlight films, reels, and edited video content: Approximately 6 to 12 weeks.

Delivery times may vary based on:

• Event size

• Seasonal demand

• Editing complexity

• Staff availability

• Revision requests

• Peak wedding and event seasons

• Public holidays

• Circumstances outside Vanguard's control

Estimated delivery dates do not constitute a guarantee.

​

Revisions

​

Where revisions are included within a package, the Client must provide all feedback within five (5) business days of delivery.

​

Revision requests must be submitted in a single consolidated list.

​

Additional revisions beyond those included may incur additional charges.

​

Media Storage & Retention

​

Vanguard will generally retain delivered media for approximately one (1) month after final delivery.

​

After this period, media may be permanently deleted, archived offline, or become inaccessible.

​

Vanguard makes no guarantee regarding long-term storage or future retrieval of files.

​

The Client is solely responsible for downloading, backing up, and safeguarding all delivered media immediately upon receipt.

​

Promotional Use

​

Unless otherwise requested in writing before the event, the Client grants Vanguard permission to use photographs, videos, reviews, testimonials, and event content for:

• Portfolio purposes

• Website content

• Social media

• Marketing materials

• Advertising

• Industry awards

• Publications

• Business promotion

​

Clients may opt out by providing written notice before the event date.

​

Acceptance

​

By accepting a quotation, paying a deposit, making a booking, or making full payment for photography or videography services, the Client acknowledges and agrees to these Photography & Videography Intellectual Property, Delivery & Usage Rights.

​

These provisions are governed by the laws of Queensland, Australia and form part of Vanguard Events & Entertainment's Terms & Conditions.

​
